Cum se depune o reclamatie
Ce este o reclamaţie / sesizare?

“Prin petiţie se înţelege cererea, reclamaţia, sesizarea sau propunerea formulată în scris ori prin poştă electronică, pe care un cetăţean sau o organizaţie legal constituită o poate adresa autorităţilor şi instituţiilor publice centrale şi locale, serviciilor publice descentralizate ale ministerelor şi ale celorlalte organe centrale, companiilor şi societăţilor naţionale, societăţilor comerciale de interes judeţean sau local, precum şi regiilor autonome, denumite în continuare autorităţi şi instituţii publice”, conform art. 2 din O.G. nr. 27/2002 privind reglementarea activităţii de soluţionare a petiţiilor.

Cine poate depune o reclamaţie la ANPC?

„Consumatorul – orice persoană fizică sau grup de persoane fizice constituite în asociaţii, care acţionează în scopuri din afara activităţii sale comerciale, industriale sau de producţie, artizanale ori liberale ”, conform art. 2, pct. 2 din O.G. nr. 21/1992 privind protecţia consumatorilor, republicată.

- Reclamaţiile şi sesizările adresate ANPC pot fi depuse doar de către consumatori persoane fizice.

- Divergenţele între operatorii economici nu intră în sfera de competenţă a Autorităţii Naţionala pentru Protecţia Consumatorilor.


„Petiţiile anonime sau cele în care nu sunt trecute datele de identificare a petiţionarului nu se iau în considerare şi se clasează”, conform art. 7 din O.G. nr. 27/2002.
Cum depuneţi o reclamaţie?

Vă rugăm să apelaţi la această modalitate numai după ce încercaţi să rezolvaţi amiabil problema cu operatorul economic care a comercializat produsul sau a prestat serviciul.


În situaţia în care nu aţi ajuns la o înţelegere cu vânzătorul sau cu administratorul unităţii, atunci aveţi dreptul să depuneţi o reclamaţie la Comisariatul Judeţean pentru Protecţia Consumatorilor.


Primirea reclamaţiilor de la consumatori se face la sediile Comisariatelor Judeţene pentru Protecţia Consumatorilor sau la Comisariatul pentru Protecţia Consumatorilor al Municipiului Bucureşti, in functie de raza teritoriala in care isi desfasoara activitatea operatorul economic.
Conform prevederilor legale reclamaţiile şi sesizările se fac în format scris sau în format electronic şi se transmit prin poştă clasică sau electronică la sediile comisariatelor judeţene sau se depun personal.

Reclamaţia sau sesizarea se face în nume personal.

Reclamaţia/sesizarea dumneavoastră se rezolvă în termenul legal (conform prevederilor O.G. nr. 27/2002), cu conditia ca aceasta să fie însoţită de toate documentele probatorii, respectiv factura fiscală, bon fiscal sau chitanţa, contract, certificat de garanţie sau alte documente, după caz.

Reclamaţiile dvs. pentru a putea fi instrumentate de către comisarii din cadrul Comisariatelor Judeţene trebuie să îndeplineasca condiţiile prezentate mai sus. În caz contrar acestea se clasează din lipsa de informaţii.

În situaţia în care nu sunteti mulţumiţi de modul în care a fost rezolvată reclamaţia dumneavoastră de către Comisariatul Judetean pentru Protecţia Consumatorilor la care a fost depusă sau acesta a răspuns peste termenul prevăzut de lege, vă puteţi adresa în scris Comisariatului Regional pentru Protecţia Consumatorilor în subordinea căruia se află Comisariatul Judeţean pentru Protecţia Consumatorilor.
